Trespass

Trespassing is a key concern in security enforcement, requiring a strong understanding of legal distinctions, enforcement procedures, and property rights. This course covers the definitions and differences between criminal and civil trespass, legal responsibilities regarding private and public property, and guidelines for handling loitering and unauthorized access. Participants will also learn about legal exceptions, constitutional concerns related to free speech, and the appropriate use of force in protecting property.

• Loitering laws and distinctions from trespassing offenses
• Avoiding legal liability for false imprisonment or excessive force

Public Accommodations & Free Speech Concerns

• Trespassing laws in shopping malls, office buildings, and private businesses
• Constitutional rights and time, place, and manner restrictions on free speech
• Legal cases interpreting access to public and quasi-public spaces

Use of Force & Property Defense

• Legal limitations on using force to remove trespassers
• Deadly force considerations and liability risks
• Employer policies and best practices for managing trespass incidents
